Welcome to the Terms & Conditions page for applications created by EdTech Interactive Company Limited ("EdTech Interactive").
By accessing and using our applications ("the Application"), you will be deemed to have accepted the terms and conditions (the "Application Terms") of the Application. If you do not agree to abide by the above, please do not use the Application.

2. Using our Services

The Site, our services and the Application are collectively called the Services (the "Services"). You may use our Services only as permitted by Application Terms and any applicable laws. Don't misuse our Services. You may discontinue your use of the Services at any time by removing this Application from your mobile device.

3. Changes to Terms or Services

We are constantly changing and improving our Services. We may add or remove functionalities or features of the Services at any time, and we may suspend or stop a Service altogether.
We may modify Application Terms at any time. We will post any modification to the respective pages. Changes will not be applied retroactively and generally will become effective 14 days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you don't agree to any modified terms in the Application Terms, you'll have to stop using the affected Service.

4. Confidentiality

You agree not to disclose EdTech Interactive confidential information (the "Confidential Information") without our prior written consent. Confidential Information includes: (a) all EdTech Interactive software, technology and documentation relating to the Services; (b) the existence of, and information about, beta features in the Services; and (c) any other information made available by EdTech Interactive that is marked confidential or would normally be considered confidential under the circumstances in which it is presented. Confidential Information does not include information that you already knew prior to your use of the Services, that becomes public through no fault of yours, that was independently developed by you, or that was lawfully given to you by a third party. Notwithstanding this Section 4, you may accurately disclose the gift and the quantity of gift resulting from your use of the Services.

5. Privacy

Your use of Services is subject to the EdTech Interactive Privacy Policy in effect at the time of your use, which is incorporated herein as though set forth in full. We collect, process, disclose, retain or use your personal data in accordance with the EdTech Interactive Privacy Policy. 6. Who May Use the Services

You may use the Services only if you are capable of forming a binding contract and are not barred from using the Services under applicable law.

7. Rights in Application

Subject to your compliance with Application Terms, EdTech Interactive grants you a limited nonexclusive, non-transferable, non-sublicensable license to download and install a copy of the Application on a mobile device and to run such copy of the Application solely for your own personal noncommercial purposes. Except as expressly permitted in Application Terms, you may not: (a) copy, modify, or create derivative works based on the Application; (b) distribute, transfer, sublicense, lease, lend, or rent the Application to any third party; (c) reverse engineer, decompile, or disassemble the Application; or (d) make the functionality of the Application available to multiple users through any means. EdTech Interactive reserves all rights in and to the Application not expressly granted to you under Application Terms.

8. Content and Content Rights

For purpose of Application Terms: Content (the "Content") means the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features, works of authorship of any kind, and information or other materials that are posted, generated, provided, or otherwise made available through the Services;
Subject to your compliance with Application Terms, EdTech Interactive grants you a personal, noncommercial, nonexclusive, non-transferable, non-sublicensable, revocable license to download, view, display, and use the Content solely in connection with your permitted use of the Services.

9. Conduct and EdTech Interactive's Enforcement Rights

You agree that you are responsible for your own conduct and safety while using the Services, and for any consequences thereof.
Although EdTech Interactive is not obligated to monitor access to or use of the Services or Content or to review or edit any Content, we have the right to do so for the purpose of operating the Services, to ensure compliance with Application Terms, and to comply with applicable law or other legal requirements. We have the right to investigate violations of Application Terms or conduct that affects the Services. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.

10. Feedback

We welcome feedback, comments, and suggestions for improvements to the Services (the "Feedback"). You can submit Feedback by reaching out to us on Facebook or email. You grant to us a nonexclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable, and transferable license under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon and otherwise exploit the Feedback for any purpose.

11. Links to Third Party Websites or Resources

The Services may contain links to third party websites or resources. We provide these links only as a convenience and are not responsible for the content, products, or services on or available from those websites or resources or links displayed on such websites. You acknowledge sole responsibility for and assume all risk arising from your use of any third party websites or resources.

12. Termination

We may terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you. You may also discontinue your use of the Services at any time by removing this Application from your mobile device. Upon any termination, discontinuation, or cancellation of Services or account, the following provisions of Application Terms will survive: Rights in Application, Content and Content Rights, Termination, Disclaimer of Warranties, Limitation of Liability and General Terms.

13. Disclaimer of Warranties

The Services and Content are provided "as is", without warranty of any kind. Without limiting the foregoing, we explicitly disclaim any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement, and any warranties arising out of course of dealing or usage of trade.
We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any Content.
You assume all risks relating to your online or offline communications and interactions with other users of the Services and with other persons with whom you communicate or interact as a result of your use of the Services. You understand that EdTech Interactive does not screen or inquire into the background of any users of the Services. EdTech Interactive makes no representations or warranties as to the conduct of users of the Services. You agree to take reasonable precautions in all communications and interactions with other users of the Services and with other persons with whom you communicate or interact as a result of your use of the Services, particularly if you decide to meet offline or in person.

14. Limitation of Liability

Neither EdTech Interactive or any other party involved in creating, producing, or delivering the Services or Content will be liable to you for any indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute Services, arising out of or in connection with Application Terms, or from the use of or inability to use the Services or Content, or from any communications, interactions, or meetings with other users of the Services or persons with whom you communicate or interact as a result of your use of the Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not EdTech Interactive has been advised of the possibility of such damages, even if a limited remedy set forth herein is found to have failed of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
In no event will EdTech Interactive's total liability arising out of or in connection with Application Terms or from the use of or inability to use the Services or Content exceed HK$500. The exclusions and limitation of damages set forth above are fundamental elements of the basis of the bargain between EdTech Interactive and you.

15. General Terms

The Application Terms and any action related thereto will be governed by the law of Hong Kong Special Administrative Region without regard to its conflict of law provisions. Application Terms constitute the entire and exclusive understanding and agreement between EdTech Interactive and you regarding the Services and Content, and Application Terms supersede and replace any and all prior oral or written understandings or agreement between EdTech Interactive and you regarding the Services and Content. If any provision of Application Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of Application Terms will remain in full force and effect. You may not assign or transfer Application Terms, by operation of law or otherwise, without EdTech Interactive's prior written consent. Any attempt by you to assign or transfer Application Terms, without such consent, will be null. EdTech Interactive may freely assign or transfer Application Terms without restriction. Subject to the foregoing, Application Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.
Any notices or other communications provided by EdTech Interactive under Application Terms, including those regarding modifications to Application Terms, will be given: (a) via email; or (b) by posting to the Services. For notices made by email, the date or receipt will be deemed the date on which such notice is transmitted.
EdTech Interactive's failure to enforce any right or provision of Application Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of EdTech Interactive. Except as expressly set forth in Application Terms, the exercise by either party of any of its remedies under Application Terms will be without prejudice to its other remedies under Application Terms or otherwise.
